Introduction
In December of 2006, the Federal Rules of Civil Procedure were amended for the tenth time since their inception in 1938. Most of the changes centered on the management and production of Electronically Stored Information (ESI). The new rules certainly clarified some of the questions surrounding ESI, but more importantly, they confirmed that ESI is a viable source of evidence requiring organizations to assimilate electronic discovery as a common business process.
